Buying New Construction? The Builder’s Team Is Not Your Team

One of the most common and most expensive misunderstandings in new construction is assuming the friendly agent in the model home is there to represent you. They are not. They work for the builder, and their job is to protect the builder's interests.

That does not make them dishonest. It makes them one side of a negotiation in which, unrepresented, you are the only party without an advocate.

Independent representation covers builder selection, incentives, contracts, upgrades, inspections, timelines and closing. Each of those is a decision point where the default option favors the builder unless someone is asking questions on your behalf.

Contracts deserve particular attention. Builder contracts are written by the builder's counsel and are rarely as fixed as they are presented. Incentives, upgrade allowances, timelines and remedies for delay are all worth examining before signing.

Bring your representation to the first visit. Many builders require your agent to accompany you on your initial registration for that representation to apply, so a single unaccompanied walk-through can cost you an advocate for the entire build.
